Gerry has just finished reading several book chapters which he found very useful. So, he decided to scan them and post them on Facebook.

Is this use covered by the UT System Copyright Clearance Center Annual License?

This is not covered by the Copyright Clearance Center Annual License. The License only covers use of printed material within the UT System. By posting on Facebook, Gerry has made it available to a much wider community. The material Gerry has posted is probably copyrighted. If so, he will have to ask permission of the copyright holder.

Copyright Question Two

John wants to copy a paper from a journal for all the members of his class at the UT Health Science Center. It is important that everyone has their own copy. Is this use covered by the UT System Copyright Clearance Center Annual License?

Yes

Correct

The paper should be from a journal held in the collections of the Briscoe Library, or it could be from another library in the UT System. As John will be distributing copies of the paper to students in the UT System, this is allowable under the terms of the UT Copyright Clearance Center Annual License.

Sharing Copyright Protected Material

The UT System has a Copyright Clearance Center Annual License. The license permits the reuse of text based content (that is, the copying and distribution) at all UT institutions for purposes such as course packs, classroom handouts, library reserves, email and electronic course content. This means the material can be freely shared between faculty, students and staff of the university.

Copyright Question One

Charlie had some great ideas about how to teach the Krebs Cycle. He explained it all to his friend Steve who agreed they were very innovative. Charlie meant to write his ideas down but kept on forgetting. Later that semester, Steve submitted a paper to a leading educational journal, using Charlie’s ideas. The paper was accepted for publication. Who owns the copyright?

Steve owns the copyright because he created it in a fixed form.

Ideas cannot be copyrighted.

Charlie owns the copyright because it was his idea.

Incorrect

Charlie had the original idea but he did not write it down or in some way ‘fix’ it in a ‘fixed form’. Steve actually created in a fixed form.

Who owns copyright?

Copyright exists in a work at the time it becomes fixed in some tangible medium of expression. That means that an image you have downloaded from the Internet is almost certainly subject to copyright protection.

Copyright protects “original works of authorship”. Copyright does not protect ideas if they are only verbally expressed.
Exceptions include Public Domain and all materials created by the US Federal Government. The Public Domain should not be confused with information found in books, periodicals or on the Internet. The Public Domain is all those works that are no longer protected by copyright or never were.

In the United States, works before 1923 are usually in the Public Domain and are not subject to copyright. Nearly all works created after 1923 are subject to copyright protection. Copyright protection usually lasts for the author’s life plus an additional 70 years after the author’s death.

Governor Dolph Briscoe Jr., 1923-2010

The UT Health Science Center library located on the Long Campus in San Antonio is named after Dolph Briscoe Jr., who served as the 41st governor of Texas from 1973 to 1979.

On November 14, 1985 a ceremony was held to dedicate the library, which was completed in 1983 after many years of planning. Governor Briscoe was present at the event, along with his wife, UT System Regent Janey Briscoe; as well as John P. Howe, III, former president of the UT Health Science Center; Donald A.B. Lindberg, Director, National Library of Medicine; and Jess Hay, Chairman, The University of Texas System Board of Regents.

An excerpt from the dedication program speaks to Governor Briscoe’s commitment to education:

The library building at The University of Texas Health Science Center at San Antonio is named to honor former Governor Dolph Briscoe, Jr. Mr. Briscoe, Uvalde rancher, served as governor during 1973-79. During his administration, the appropriation of funds for public and higher education increased. Since leaving office, Governor Briscoe has been active in support of community service programs.

In announcing the dedication, the former Regents’ Chairman Jon Newton said, “No resource of any campus, whether it be academic or health-related, is of more importance than the library. At the health science center in San Antonio, the library serves medical, dental, nursing, allied health and graduate students in the medical sciences. It stands as a symbol of excellence in their continued quest for knowledge.”

What better honor than to dedicate a library of national distinction to an individual who has been so supportive of higher education.

Everyday Miracles Exhibit at the Ramirez Library

Ex-voto The Mario E. Ramirez, M.D., Library at the Regional Academic Health Center in Harlingen is hosting a traveling exhibit from the National Library of Medicine called, Everyday Miracles: Medical Imagery in Ex-Votos.

The exhibit explores the relationship between healing and faith through the ex-voto, a devotional painting that gives thanks for a miraculous healing or blessing. The exhibit will run from May 7^th – June 16^th.
